I tried to research this.. here’s what I came up with:
- It’s illegal to produce, assist in producing, model for, or otherwise have anything to do with the production of “obscene materials” in the state of Virginia if you have the intent to distribute or sell those materials. To the State, “distribute” means anything from mass distribution to you physically handing the photo over to someone else.
- It doesn’t appear to be illegal to have the photos developed if you intend to keep them for yourself only. (VA codes pertaining to sex)
I think some photo places have a policy of discarding any sexually explicit photos, others will turn a blind eye. I’m not really sure I would develop said photos of myself or my partner at a photo shop.. they can and do print themselves off extra copies of photos they particularly like.
As an aside, during this research, I discovered this gem in the VA law codes: “If any persons, not married to each other, lewdly and lasciviously associate and cohabit together, or, whether married or not, be guilty of open and gross lewdness and lasciviousness, each of them shall be guilty of a Class 3 misdemeanor; and upon a repetition of the offense, and conviction thereof, each of them shall be guilty of a Class 1 misdemeanor.” (VA Code ยง 18.2–345)
