The sentence recommended by the DA’s office will also depend on the circumstances and the criminal history of the perpetrator. If it’s a first time crime, the sentence may (not WILL but MAY) be lighter than if it’s a career criminal that did it. That’s one example of the criteria that they will use when they make a sentencing recommendation and that the Judge will use when imposing a sentence.
The only other factor to keep in mind is that in addition to the basic offsense, the particular facts can result in the assault being charged as 1st, 2nd, or 3rd degree.
So if you’re in fact thinking of punching someone out – Don’t. Thinking about it makes it predmeditated. Not good.
