The Tenth Amendment restates the Constitution’s principle of Federalism by providing that powers not granted to the National government nor prohibited to the states are reserved to the states and to the people.
The common accepted truism is that is that the Constitution does not grant the National Government any power that it does not expressly mention. For example an amendment needed to be created granting the government authority to abolish slavery.
The second view is that the tenth amendment gives the Federal government the power to exercise power in ways not expressly denied by the first eight amendments.
With the passing of this enormous stimulus bill by the White House a precedent maybe established of increased Federal authority over the state’s sovereignty.
The state of Oregon seems to be trying to head off the Federal Government at the pass.
Many free thinkers across the political spectrum would eliminate the Federal Reserve and slash the Federal Budget stating that these activities of the National Government are overstepping its original purpose. I wholeheartedly agree as the Federal Reserve has far too much private banking interest at it’s core.
The activities of the Federal Government are increasingly unconstitutional and the states must make a stand.
