The reason I asked about pre-existing violations is that most times in traffic court, they’ll be very lenient on first offenses. Even without a lawyer, you can plea bargain down to a minor offense with negligible punishment.
Unfortunately, it seems you’ve already had your day in court. The judge has all the latitude in the world to punish the offense within the limits of the statute (in some states, exceeding the speed limit by 15 mph is sufficient cause to suspend a license altogether).
So I hope you’re able to get a transcript or otherwise convince the judge that a clerical error was made. For a first offense, and I would make mention of that at every possible opportunity, they should be willing to listen.
Again, getting a lawyer would likely help the most at this point, if your husband is unable to talk to the judge directly today.
